The Fair Housing Act
The Fair Housing Act prohibits discrimination in housing-related transactions based on:
- Race
- Color
- National Origin
- Religion
- Sex
- Familial Status (families with children under 18)
- Disability
This protection applies to all aspects of the home buying and lending process, including mortgage lending, appraisals, and other real estate-related transactions.
Your Protected Rights
Under the Fair Housing Act, it is illegal to:
- Refuse to make a mortgage loan or provide other financial assistance for a dwelling
- Refuse to provide information regarding loans
- Impose different terms or conditions on a loan (such as different interest rates, points, or fees)
- Discriminate in appraising property
- Refuse to purchase a loan
- Set different terms or conditions for purchasing a loan
Equal Credit Opportunity Act (ECOA)
In addition to the Fair Housing Act, the Equal Credit Opportunity Act (ECOA) prohibits discrimination in any aspect of a credit transaction based on:
- Race or color
- Religion
- National origin
- Sex
- Marital status
- Age (provided the applicant has the capacity to contract)
- Receipt of income from any public assistance program
- Good faith exercise of any right under the Consumer Credit Protection Act
